Terms of Service for Myzine

1. Acceptance of Terms

By downloading, installing, or using the Myzine iOS application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Myzine is an AI-powered magazine creation and delivery service that:

• Curates personalized content based on your selected interests
• Generates custom magazine covers using AI technology
• Delivers magazine issues on a schedule you choose (every 3, 5, or 7 days)
• Provides a mobile reading experience on iOS devices

3. User Accounts

3.1 Account Creation

To use Myzine, you must:

• Be at least 13 years of age
• Provide a valid email address
• Create a secure password
• Verify your email address

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Subscriptions & Payments

4.1 Subscription Tiers

Myzine offers the following subscription tiers:

• Free: Create 1 magazine with custom cover (issues require subscription)
• Standard ($5.99/month): 2 magazines, automated issue delivery, one can run every 3 days
• Premium ($12.99/month): 10 magazines (5 active), full cadence control, pause/resume capability, early access

4.2 Payment Terms

• All payments are processed through Apple's In-App Purchase system
• Subscriptions automatically renew unless cancelled 24 hours before the renewal date
• You can manage or cancel subscriptions in iOS Settings → Your Name → Subscriptions
• No refunds for partial subscription periods
• Prices may change with 30 days notice

4.3 Free Trial

If a free trial is offered, you will be charged at the end of the trial period unless you cancel before it ends. Your subscription begins immediately upon trial expiration.

5. Content & Intellectual Property

5.1 Magazine Content

• Content in your magazines is curated from publicly available sources
• We do not claim ownership of third-party content
• Magazine issues are for your personal, non-commercial use only
• You may not redistribute, resell, or share generated content

5.2 AI-Generated Covers

• Cover images are generated using AI image generation technology
• You may use covers for personal purposes within the app
• Cover images may not be used for commercial purposes without permission

5.3 Your Magazine Customizations

You retain ownership of:

• Magazine titles you create
• Cover customizations (text placement, colors, etc.)
• Topic selections and preferences

6. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer or hack the App
• Upload malicious code or interfere with the service
• Share your account credentials with others
• Use automated tools to access the service
• Violate intellectual property rights
• Create magazines with offensive, harmful, or illegal content prompts

7. Service Availability

• We strive for 99% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance may cause temporary downtime
• AI content generation depends on third-party services and may occasionally fail
• We are not liable for service interruptions or content generation delays

8. Data & Privacy

Your use of Myzine is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

8.1 Data Deletion

You may delete your account at any time from the Profile section in the app (Profile → Delete Account). All your data will be permanently deleted within 30 days. You can also contact jacknkalen@gmail.com for assistance.

9. Termination

9.1 Your Rights

• You may cancel your subscription at any time
• You may delete your account at any time
• Upon cancellation, you retain access until the end of your billing period

9.2 Our Rights

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Abuse the service or harm other users

10. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

• We do not guarantee the accuracy or completeness of curated content
• AI-generated content may occasionally contain errors or inaccuracies
• We are not responsible for third-party content linked in magazines
• Magazine cover generation quality depends on AI technology and may vary

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not responsible for content accuracy, completeness, or timeliness

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending a push notification for material changes

Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws applicable to the jurisdiction where the service is provided. Myzine is operated by an independent developer.

14. Dispute Resolution

15. App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• Apple is not a party to these Terms and has no obligations with respect to the App
• Apple is not responsible for the App, its content, maintenance, or support
• Any claims related to the App are between you and Myzine, not Apple
• In case of any third-party claim that the App infringes intellectual property rights, we (not Apple) are responsible
